Terms of service
1. Company Status & No Brand Affiliation
959 Deluxe is an independent luxury resale company and is not affiliated with, endorsed by, sponsored by, or associated with any designer brands, manufacturers, or trademark holders referenced in connection with the Services.
2. Seller Eligibility & Representations
By submitting any product to 959 Deluxe, you represent, warrant, and agree that:
· You are at least eighteen (18) years old and have the full legal capacity to enter into binding agreements;
· You are the lawful owner of the product and have full right, title, and authority to sell and transfer ownership of the product;
· The product is not counterfeit, stolen, fraudulent, and is free of any liens, encumbrances, or third-party claims;
· The product complies with all applicable local, state, federal, and international laws, including import and export regulations.
3. Product Eligibility & Condition Standards
959 Deluxe determines, in its sole and absolute discretion, which products are eligible for review or purchase.
All products received must accurately and fully conform to the condition, descriptions, representations, and included accessories or components provided by the seller at the time of submission.
Any discrepancy, variance, omission, or inconsistency—including but not limited to visible wear, damage, alterations, missing components, or heavy signs of use—may, at the sole discretion of 959 Deluxe, result in rejection of the product or issuance of a revised offer.
4. Offers – Non-Binding Nature
All offers issued by 959 Deluxe are non-binding, indicative only, and do not constitute an obligation to purchase.
An offer becomes binding only after the product is received, inspected, authenticated, and formally accepted by 959 Deluxe.
All offers automatically expire seven (7) days from issuance unless accepted earlier.
959 Deluxe reserves the right to cancel or revoke any offer at any time prior to acceptance.
5. Shipment & Delivery
You must ship your product to 959 Deluxe within seven (7) days after accepting an offer.
Failure to ship within this period may result in automatic cancellation of the offer.
You are solely responsible for proper packaging and shipment. Risk of loss or damage remains with you until the product is received and opened by 959 Deluxe.
6. Inspection & Recalculated Offers
All products received are subject to inspection and verification.
959 Deluxe may issue a recalculated offer if:
· The product does not match the description provided;
· The condition materially differs from what was represented;
· Required accessories or components are missing;
· The product is received after the delivery period.
Deemed Acceptance
If a recalculated offer is issued:
· You will have five (5) calendar days to accept or reject the new offer;
· Failure to respond within five (5) days shall be deemed acceptance, regardless of whether the notification email was read, received, blocked, or filtered.
Once accepted—either expressly or by default—the transaction is final and non-reversible.
Notice shall be deemed given upon transmission to the email address you provided, regardless of actual receipt.
7. Authentication – Final, Binding & Non-Appealable
All submitted products undergo an authentication review conducted by 959 Deluxe’s internal experts using industry-standard methodologies and professional judgment.
You expressly acknowledge and agree that authentication determinations are expert opinions, not guarantees, certifications, or appraisals.
All authentication determinations are final, binding, and non-appealable.
You irrevocably waive any right to dispute, challenge, contest, initiate legal action, arbitration, chargeback, payment reversal, or third-party claim arising from or related to any authentication determination.
8. Non-Conforming or Rejected Products – Fees, Return & Abandonment
DO NOT SUBMIT UNAUTHENTIC OR MISREPRESENTED PRODUCTS.
If a product is determined, following inspection and authentication, to be inauthentic, counterfeit, fraudulent, otherwise unlawful, or materially inconsistent with the seller’s representations, or if the seller rejects a recalculated offer, the following terms shall apply:
· No payment will be issued for the product;
· A non-refundable $50 authentication, processing, and return shipping fee will be assessed;
· Upon receipt of the applicable fee, the product will be returned using a shipping method selected at the sole discretion of 959 Deluxe;
· If the required fee is not paid within a reasonable timeframe, the product may be deemed abandoned and may be retained, disposed of, or otherwise processed in accordance with applicable law, and to the extent permitted by law, may become the property of 959 Deluxe.
You acknowledge and agree that inspection and authentication involve professional expertise, time, and administrative resources, and that the above fee constitutes reasonable and fair compensation to 959 Deluxe for such services.
9. Risk of Loss
· Risk of loss remains with you until the product is received and opened by 959 Deluxe;
· If a product is returned, risk of loss transfers back to you once the product is delivered to the carrier;
· 959 Deluxe is not responsible for carrier delays, loss, or damage once the package is handed to the carrier.
10. Transfer of Title
Title to the product transfers to 959 Deluxe only upon acceptance of the original or recalculated offer.
If an offer is rejected or expires, title remains with you.
11. Buyback Program (If Offered)
Any buyback program offered by 959 Deluxe is:
· Discretionary and not guaranteed;
· Subject to re-authentication and condition verification;
· Based on the inspection, authentication, and valuation of the product as received by 959 Deluxe at the time of submission.
959 Deluxe reserves the right to refuse any buyback request for any reason and at its sole discretion.
12. Payments & No Chargeback
Payments will be issued using the method selected by 959 Deluxe after the transaction is finalized.
You are solely responsible for providing accurate and up-to-date contact and payment information.
Once payment is issued, you agree not to initiate any chargeback, payment reversal, or financial dispute.
Any such attempt constitutes a material breach of these Seller Terms and may result in legal action and recovery of damages, administrative costs, and attorneys’ fees.
13. Limitation of Liability
To the fullest extent permitted by law, 959 Deluxe shall not be liable for:
· Lost profits or business opportunities;
· Indirect, incidental, or consequential damages;
· Carrier delays or third-party actions.
In all cases, liability shall not exceed the amount actually paid to you for the applicable product.
14. Indemnification & Attorneys’ Fees
You agree to indemnify, defend, and hold harmless 959 Deluxe Inc., its officers, directors, employees, agents, and affiliates from any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:
· Your breach of these Seller Terms;
· Submission of counterfeit, stolen, or unlawful products;
· Misrepresentation of ownership, authenticity, or condition.
The prevailing party in any dispute shall be entitled to recover reasonable attorneys’ fees and costs.
15. Right to Refuse Service
959 Deluxe reserves the right, in its sole discretion, to refuse service, reject submissions, or terminate relationships with any individual or entity at any time, with or without cause or prior notice.
16. Governing Law & Venue
These Seller Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Seller Terms shall be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction.

Continued use of the Services constitutes acceptance of the revised terms.
